Who Can Apply

If you are an adult (18 years and over) you may apply for a Change of Name if:

  • You were born in New South Wales, or
  • Your birth was registered in New South Wales, or
  • You are a permanent resident of Australia and are ordinarily a resident in New South Wales, or
  • You are an Australian citizen and are ordinarily a resident in New South Wales

If you are under 18 years of age your parents (as recorded on your Birth Certificate) or Primary Care-Giver may apply to change your name on your behalf if.

  • You were born in New South Wales, or
  • Your birth was registered in New South Wales, or
  • You are a permanent resident of Australia and are ordinarily a resident in New South Wales, or
  • You are an Australian citizen and are ordinarily a resident in New South Wales.

An application for registration of a child's name may be made by one parent if:

(a) The applicant is the sole parent named in the registration of the child's birth under the Births, Deaths and Marriages Registration Act 1995

(b) There is no other surviving parent of the child, or

(c) A court approves the proposed change of name.
